مبانی فقهی تنظیم خانواده

"مبانی فقهی تنظیم خانواده" اثر فقهی فاخر حجت الاسلام و المسلمین سید حسن خمینی است که نگاهی نوین به مساله جواز و حرمت تنظیم خانواده می پردازد.

نویسنده در مقدمه کتاب، بحث تحدید نسل و تنظیم خانواده را در زمره مسائل مستحدثه و ثانویه برمی شمارد که امروزه به دلیل نیاز روز و سیاست های نظام جمهوری اسلامی، توجه جدی به آن می شود. این کتاب که با راهنمایی اساتیدی چون آیت الله شبیری زنجانی، آیت الله محقق داماد و آیت الله مومن در سالهای 80 و 81 نگارش یافته، حاوی 5 مقدمه علمی و چهار فصل است. در مقدمه اول، دو واژه جمعیت شناسی و تنظیم خانواده بصورت آکادمیک تعریف شده است. مقدمه دوم به نظریات جمعیت شناسی اختصاص دارد که در آن به بررسی دیدگاه های موافقان و مخالفان افزایش جمعیت پرداخته شده است. همچنین بررسی جمعیت ثابت و جمعیت متناسب نیز دیگر مباحت این مقدمه است. حکم ثانوی در مساله تنظیم خانواده موضوع مقدمه سوم، وظیفه حکومت اسلامی در این باره موضوع مقدمه چهارم و بررسی مقالات و رساله های مرتبط موضوع مقدمه پنجم است.

سید حسن خمینی در فصل اول به بررسی اصل اولی در مساله تکثیر نسل می پردازد و در فصل دوم عدم وجوب تکثیر نسل، ادله جواز عزل و ادله حرمت عزل را بررسی می کند. فصل سوم به بررسی نحوه شکل گیری نطفه، بررسی روشهای جلوگیری از تولید مثل و احکام شرعی مرتبط با گونه های مختلف این عمل اختصاص دارد. فصل جهارم نیز مربوط به تعقیم و دلایل شرعی حرمت آن، لقاح خارج از رحم و وجوب ستر عورت از اجنبی و حرمت نظر است.

"مبانی فقهی تنظیم خانواده" در 180 صفحه، توسط پژوهشکده امام خمینی و انقلاب اسلامی در سال 1382 منتشر شده است.
